These Terms and Conditions govern your use of the Lea & Sandeman website (the "Site") and your relationship with Lea & Sandeman (company registration number 2190567, VAT Number: 468 8898 54) whose registered office address is at 170 Fulham Road, London, SW10 9PR (the "Company", "we" or "us"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Site. If you have any questions on the Terms and Conditions, please contact us at .
Special terms apply to sales of wines offered 'En Primeur'(1) and to wines sold from any 'Broking List'(2) offered from time to time and also to some of our other offers. We will notify you of these terms before you place any order for these and our website will indicate where special terms apply and these will amend or supersede the terms below.
1 Ordering
Orders may be filled and placed by clicking the 'confirm order' button. In doing this you are making an offer to buy from us within our terms. We will respond with an email confirmation of the order once your payment has been received. This confirmation email will be sent by an automated server and may end up in your junk folder. If it does please make sure our domain is white-listed so that you receive any other communications about your order as quickly as possible.
2 Payment
Payment will be accepted by debit card (Switch, Delta, Maestro, Electron), credit card (Visa, MasterCard), or charge card (American Express), except for En Primeur or Pre-shipment orders which carry their own terms. All credit and charge card transactions are subject to validation checks and authorisation by the card issuer. In addition, as extra fraud protection, the Company may (but is not obliged to) make extra checks on the names and addresses given in the order process against commercially available records such as Electoral Roll data. We may need to contact you again to verify details before we deliver, and will not be held responsible for any delay so caused.
3 Contract
At the point at which your payment is received by us a legally binding contract will exist between you and the Company, but we reserve the right to refuse or amend any order up to the point of dispatch (for wines for delivery), and you have the right of cancellation as set out below. If we have to amend your order we will always contact you before proceeding with the sale. In registering on the site or placing any order for alcohol you confirm that you are over 18. No contract shall exist between us and anyone under 18 who attempts to order or to take delivery of alcohol. If our drivers are in any doubt about this they are instructed not to leave the goods and the sale will be cancelled.
4 Availability
Lea & Sandeman does its utmost to ensure that all wines offered on the website are currently available, but availability is limited, particularly in the case of the rare wines of the small-scale producers that we offer, and all products are offered subject to availability.
5 Pricing and Discounts
Prices are given per bottle (75cl for wine, 70cl for spirits) or as otherwise listed. Our general lists display the standard bottle price followed by a discounted price for case quantities.
Discounted prices apply to a minimum quantity of one case of wine or spirits (twelve bottles or equivalent), which may be mixed in any combination across our range, subject to collection or a single delivery address.
Unless otherwise stated in respect of particular offers, prices include duty and VAT and are quoted in £ sterling.
Whilst we make every effort to ensure availability of wines offered and correct pricing, mistakes can occur. If a product is accidentally offered at an incorrect price, we reserve the right to refuse to supply at the incorrect price and will contact you to see if you wish to proceed with the sale at the correct price.
If we make a time-limited offer, any date given will be a guide only and we will not be obliged to fulfil orders up to that date. We reserve the right to change any price or offer without notice.
6 Delivery
Show details.7 Acceptance
Any claims for short delivery or breakage or any other defect or deficiency must be notified to us or any third-party courier immediately.
You will be deemed to have accepted the goods as delivered and in fulfilment of your order unless we hear from you within three days of collection or delivery, and you will not be entitled to reject them thereafter except as set out below.
8 Cancellation and Complaints
Orders delivered may be cancelled by you within seven days of receipt (by you or your designated delivery point), without your giving a reason. In this case the goods (in good condition and unopened) must either be returned to us or made available for collection.
If we collect a collection fee will be payable.
If we are unable to accept return because the goods are not in good condition or have been opened, a re-delivery fee will also be payable.
Upon receipt and acceptance by us we will refund all payments (less any collection or delivery charges) within 30 days.
This right of cancellation does not apply to 'en primeur' sales nor to some other sales (including Broking List wines or wines offered In Bond) for which special terms will apply.
9 Quality Charter
Lea & Sandeman does its utmost to make sure that wines are delivered to you in the best possible condition.
There is always an element of risk in the purchase of the older fine wines as their condition is inevitably variable. The prices at which we offer these to you reflect this.
We undertake the proper safekeeping and storage of wines in our possession and will act in good faith when purchasing wine, but we will not be responsible for the state and condition of wines or whether the wine corresponds to the qualities which might be expected from its description.
Wines that have been simply kept too long or mistreated will not be refunded.
At our complete discretion, we will consider replacing the remainder of any other case sold which is not drinkable.
If you wish to return any wine, please call 020 7244 0522 or email to arrange collection. Opened bottles must be retained and made available for collection.
Refunds will be made to the credit card used for the original purchase after deducting 5% of the invoice total to cover our costs, including charges by your credit card company.
This does not affect your statutory rights.
10 Special Terms
We will notify you as to any special terms before you confirm any order. Placing an order following such notification will constitute acceptance of any special terms we have notified to you.
11 Force Majeure
We shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
12 Severance
Any of these Terms and Conditions which is or may be void or unenforceable shall to the extent of such invalidity or unenforceability be deemed severable and shall not affect any other Term or Condition.
